In a significant legal development, the Anti-Terrorism Court of Islamabad has issued a show cause notice to the Superintendent of Adiala Jail for failing to present Iman Mazari and her husband Hadi Ali via video link. The court session, presided over by Judge Tahir Abbas Sipra, addressed the absence of power of attorney documents required to file bail applications for the couple.
Adiala Jail: Court Proceedings
During the hearing, it was revealed that officials at Adiala Jail did not provide the necessary signed power of attorney documents from the lawyers representing Mazari and Ali. Despite the absence of jail authorities in court, a significant number of other attorneys, including Shireen Mazari, were present to advocate for the defendants.
Bail Granted
The court subsequently granted bail to Iman Mazari and Hadi Ali, temporarily halting the trial court's decision. The bail was approved upon the payment of a surety bond of 200,000 Pakistani Rupees.
Failure to Comply
However, despite the court’s ruling, the couple was not presented via video link, prompting Judge Sipra to issue a contempt of court notice to the jail superintendent. The judge expressed dissatisfaction with the superintendent's failure to adhere to court orders, questioning, "Why should a six-month sentence not be imposed? The superintendent should not wall himself off from the courts or the defendants."
Court staff indicated that the failure to present Mazari and Ali stemmed from internet connectivity issues cited by jail authorities. The judge countered this by recalling earlier directives he had issued to ensure that technical experts assist in resolving the connectivity problems in the jail. He emphasized that the defendants’ right to legal representation is fundamental.
The court adjourned the session, postponing further proceedings until Tuesday, with a clear admonition to jail authorities to comply with judicial directives.
